1. Patent

In Malaysia, by registering a patent with the Intellectual Property Corporation of Malaysia, one can protect their patent for 20 years from the filing date. Registering a patent in Malaysia is very important in order to exploit the patented invention, assign or transmit the patent, and to conclude license contracts. Any patent owner has the exclusive right to create, use, import or put their invention on the market and also possesses the power to take legal action if anyone uses their patent without their consent.

2. Trademark

A trademark is a seal, sign, symbol or logo which differentiates the goods or services of one trader from those of others. The registration of a trademark with the Intellectual Property Corporation of Malaysia gives the owner a protection period of ten years from the date of publication, which can be further renewed every ten years. Once a trademark is registered, the owner of the same has the exclusive right to use the mark their goods and services and also gives them the power of taking legal action if anyone uses their mark without their consent.

3. Copyright

Copyright is the law which protects one’s piece of creativity or work. These works may be books, software, musical compositions, plays, photographs, drawings, paintings, sculptures, sound recordings, films, broadcasts and cable programmes. Work materials available on the internet are also subject to copyright. Once a copyright is registered with the Intellectual Property Corporation of Malaysia, the copyright protection period lasts until 50 years even after the death of the creator of the work. In Malaysia, by registering a copyright, the owner gets 3 types of rights, namely: legal right, economic right and moral right, which further gives the owner the power to make any person undergo infringement who violates the IP protection under the Copyright Act, 1987.

4. Industrial Design

An Industrial Design is basically a type of intellectual property which protects the outward appearance such as shape, configuration, pattern, or special design which has been applied to the product through an industrial process. In Malaysia, by registering an industrial design with the Intellectual Property Corporation of Malaysia, one gets the privilege of protecting their industrial design for a maximum duration of 25 years and also gets the exclusive right to make, import, sell or hire out any product to which the design has been applied.

5. Geographical Indication

A mark imprinted on products which implies a particular geographical origination or specific qualities or reputation of that origin is known as geographical indication (GI). In Malaysia, on registration of a geographical indication with the Intellectual Property Corporation of Malaysia, the GI gets ten years of protection from the date of filling, and is further renewable every 10 years.

6. Layout Design of Integrated Circuits

A layout design of an integrated circuit is the 3D arrangement of the elements of an integrated circuit and some or all of the interconnections of the integrated circuit or such 3D arrangement prepared for an integrated circuit which is meant to be manufactured. On registration, the owner gets the right to reproduce and to authorize the reproduction of their protected layout design.
